Terms of Service
These Terms of Service ("Terms") are an agreement between you and GOREST INC, 745 S Bernardo Ave, Sunnyvale, CA 94087, USA ("Gorest", "we", "us"). By creating an account or using Gorest Sprite (the "Service"), you agree to these Terms.
1. The Service
Gorest Sprite generates 2D game assets (such as sprite sheets and transparent images) from text prompts and images you provide, using third-party AI models. The Service is currently in beta and its features may change.
2. Accounts
You must be at least 13 years old (or the minimum age required in your country) to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date.
3. Credits and payments
Paid features consume prepaid credits. Credits are delivered to your account immediately upon successful payment, have no cash value, are non-transferable, and are non-refundable except as described in our Refund Policy or as required by applicable law. If a generation fails on our side, the consumed credit is automatically returned to your balance. Payments are processed by Stripe; we do not store your card details. Prices and credit amounts may change; changes do not affect credits you have already purchased.
4. Your content and generated outputs
Inputs. You retain all rights to prompts and images you upload. You grant us a limited license to host, process, and transmit them as needed to operate the Service (including sending them to our AI model providers for processing).
Outputs. To the extent permitted by law, we assign to you all our right, title, and interest in the images generated for you by the Service, including for commercial use. Due to the nature of AI, outputs may not be unique and similar outputs may be generated for other users; we make no promise that outputs do not infringe third-party rights, and you are responsible for your use of them.
5. Acceptable use
You may not use the Service to: (a) create content that is illegal, sexually explicit, or exploits or endangers minors; (b) infringe others' intellectual-property, privacy, or publicity rights; (c) harass, deceive, or harm others; (d) probe, overload, or disrupt the Service, circumvent rate limits or credit accounting, or resell programmatic access; or (e) violate any applicable law. We may remove content, refuse generations, and suspend or terminate accounts that violate these Terms; credits associated with abusive activity may be forfeited.
6. Third-party services
The Service is built on third-party providers, including Supabase (authentication, storage), Stripe (payments), Railway (hosting), and Google (image-generation models). Your prompts and reference images are processed by our model providers to produce outputs.
7. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.
8. Limitation of liability
To the maximum extent permitted by law, Gorest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for all claims relating to the Service is limited to the greater of US$50 or the amounts you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms or to comply with law. Upon termination, unused credits are forfeited unless applicable law requires otherwise.
10. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will provide reasonable notice (for example, in the app). Your continued use of the Service after changes take effect constitutes acceptance.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules. Courts located in Santa Clara County, California will have exclusive jurisdiction, and each party consents to personal jurisdiction there. Before filing a claim, please contact us — most concerns can be resolved quickly and informally. Nothing in this section deprives you of mandatory consumer protections of the country where you live.
